Prenuptial & Postnuptial Agreements

A postnuptial agreement is made after the marriage, often after a change of circumstances affecting one of the spouses. The agreement is a written contract to settle the couple’s affairs and assets in the event of a separation, divorce or death.

Like the contents of a prenuptial agreement, the agreement can vary widely, but commonly includes provisions for division of property and support (maintenance or alimony) in the event of separation, divorce or death of one of the spouses.

Postnuptial agreements have become increasingly common particularly as women have become more financially independent over time and spouses (men and women) are concerned about preserving assets for children from their prior marriages.
